Andrey Yankulov files today the appeal against the refusal of the Prosecutorial College of the Supreme Judicial Council to elect a new acting Prosecutor General

On March 11, the Prosecutorial College unanimously decided to leave without consideration the proposal of the acting Minister of Justice to appoint a temporary acting Prosecutor General. The decision can be appealed to the Supreme Judicial Council within 14 days, that is, until March 25 (Wednesday).

Today we must finalize and file an appeal with the Supreme Administrative Court against the refusal of the Prosecutorial College of the Supreme Judicial Council (SJC) to consider the proposal to appoint a new acting Prosecutor General, Acting Deputy Prime Minister and Minister of Justice Andrey Yankulov told the media before a meeting of the Judicial College of the Supreme Judicial Council, quoted by BTA.

On March 11, the Prosecutorial College unanimously decided to leave the proposal of the Acting Minister of Justice to appoint a temporary acting Prosecutor General without consideration. The decision can be appealed to the SAC within 14 days, that is, until March 25 (Wednesday).

Minister Yankulov explained that the big problem is the college's ruling, which introduces a "temporary perpetual mandate" for Sarafov, whose expiration is contingent on the fulfillment or a future uncertain event - choosing a holder or him deciding that he does not want to perform these functions. In his words, this contradicts all possible principles of the rule of law and good governance.

Regarding the documents received from the Association "Bulgaria United with One Goal" (BOEC) and the working group established in the Ministry of Justice to conduct a review, systematization and legal analysis, Yankulov indicated that a report is awaited and based on it it will be assessed whether something can be done. He added that disciplinary actions can hardly be taken based on the documents due to the expired statute of limitations.

BTA recalls that according to the justice department, the BOEC signal contains allegations of "crimes of a general nature - corruption, abuse of power, crime against justice" etc. by high-ranking officials, as well as "data on disciplinary violations and actions undermining the authority of the judiciary committed by magistrates".

In letters, Yankulov sent the BOEC signal, along with the scanned documents, to the Ministry of Interior for an inspection and taking the relevant legal measures upon establishing violations, as well as to the Chairman of the Criminal Chamber of the Supreme Court of Cassation - for an assessment of the implementation of subsequent actions under the mechanism for independent investigation of the Prosecutor General.
