Coalition Blue Bulgaria submitted a report to the prosecutor's office against the CEC for non-implementation of a legally binding decision of the Supreme Administrative Court.
With its refusal to implement the decision of the Supreme Court by registering in the list of Blue Bulgaria for candidates for members of the European Parliament from the Republic of Bulgaria under number 3 Hristo Atanasov Kostov, the CEC not only violates the Bulgarian legislation, but also grossly violates the constitutional right of Bulgarian citizen to apply and be elected.
According to Art. 58, para. 3 of the Electoral Code, the decisions of the court are not subject to appeal, they are final and enter into force immediately.
In view of the continued inaction of the CEC, after the rendering of the cited court decision, on 18.05.2024 I submitted an application by e-mail, drawing their attention to the fact that the court decision has entered into legal force and should be implemented by them. At the meeting held later that day, the application was reported to us only “for information”, without any real action to implement the court decision.
Until now, the CEC still refuses to implement the court decision that has entered into force.
In the specific case, with their inaction, the officials of the Central Election Commission not only actually violated the law, thwarting the implementation of the legally effective court decision (which inaction on the objective side reveals the signs of the act, the factual composition of which is described in Art. 296, para. 1 of the Civil Code), but in essence refusing to register a candidate, for whom the court has duly established, that he meets the requirements for registration, grossly show his constitutionally secured electoral rights to participate in the elections scheduled for 09.06. .2024 elections (which reveals the signs of the act, the factual composition of which is described in Art. 167, para. 5, para. 1 of the Criminal Code).
