The Constitutional Court declared the changes to the Constitution, which concern the division of the SJC, to be unconstitutional, but did not declare as unconstitutional those provisions that concern in addition, banning the current SJC from electing the three big ones. I don't see any surprises among lawyers. There will be two readings – that they have the right and that they are obliged to start the procedure for the election of the chief prosecutor. This was stated by the constitutionalist Assoc. Nataliya Kiselova on the air of BNT.
According to her, the constitutional judges should have declared these provisions unconstitutional – so there would be no dispute.
According to Adv. Emil Georgiev Delyan Peevski is very keen to be elected chief prosecutor while “he still has his power in the judicial system.”
„The plenum itself can stop this procedure, but the selection act is vulnerable in its final part – the president's decree is subject to the Supreme Court. Personal proposals will show whether there will be political interference, he added.
„CEC is quite well positioned. You can see three members inside from the GERB quota who have a specific position, as well as a majority with a different opinion. The commission must resolve an intra-party conflict, but this conflict also affects the institutions,”, the lawyer also said.
About the “Solomon decision” of the commission in relation to the two DPSs, Georgiev stated: “The CEC tried to make such a decision. For me, things are clear – there are instructions given that are not followed, a refusal follows.”
„The CEC does not want to enter into this intra-party dispute and is postponing a decision as long as possible. This drama continues for the eighth day now. The CEC correctly accepted the documents at the same time, so that it could then assess whether there were any flaws in them. We understand that one bank account has been provided in both coalitions. The CEC can refuse both coalitions, it can give one the party, the other – the name, and VAS can give the party and the name of one entity, and then we will see how the judiciary becomes part of the election campaign,” added Assoc. Kiselova.
