The pre-trial proceedings ended in a fairly reasonable period of time after the detention of Rangel Bizyurev and his bringing after the issued European warrant. So I wouldn't say that the process is delayed, protracted or conducted in an illegal way, on the contrary, stated Dimitar Markovski in "The day begins" on BNT, who is the lawyer of the mother of the murdered Dimitar Malinov from Tsalapitsa.
He explained that the court collects and examines all kinds of evidence quite effectively. In this case, lawyer Markovski said, there are several important points related to the fact that "our opinion at the trial is that the defendant Bizyurev was not the only participant in this serious crime.
"And the court cannot currently become an investigative body in this case, because only one defendant is on trial.
Lawyer Dimitar Markovski explained that in the pre-trial proceedings one can talk about an omission.
"It is related to a not so careful examination of some evidence within the framework of this case, in order to go in such a direction as to whether Bizyurev had an accomplice in the process.
He explained that there is no way to automatically include another co-accused of Bizyurev in the process, but this is a "good basis to separate materials in this case in order to start another pre-trial proceeding and to assess whether there is not enough data for another accomplice". A discrepancy in witness testimony, he explained, does not always mean that the course of a case is completely reversed.
"This is not so. In the activity of the court, there is the procedural possibility for the court to assess which testimonies to give credence to.
The lawyer of Dimitar Malinov's mother said that it seems to him that the presence of the media is particularly useful in matters of public interest.
"The moment a case becomes media somehow the speed and quality of work improves".
