Kiselova is an administrator and should have considered President Radev's request for a referendum. There is controversy surrounding the request for a referendum, which was initiated by Radev, but public opinion can be divided into two groups. The first is strictly legally professional, for whom Kiselova's actions were unconstitutional, illegal, unlawful. The second group is more politically tinged, I would even say with French arguments, and this does not raise the debate that supports it. The National Assembly is in this hypothesis - when a bill is introduced (in this case a proposal for a referendum), it must consider it. Simply Kiselova is an administrator and according to the Regulations on the Organization of the National Assembly, which has the rank of law, she simply observes the organization, the committees, the trash cans and so on. She arranges the agenda according to what has been submitted, and she has no right to decide whether a single item that has been submitted should be considered. In a committee, the proposal is accepted or rejected. This was announced to Lili Marinkova in the studio “FACTI“ and the program “Conversation“ by lawyer Metodi Lalov.

“Kiselova simply arranges the agenda, following the chronology of the receipt of the relevant proposals. She has no right to judge on the merits whether a bill, a referendum proposal or another individually submitted proposal should be considered or not. She simply arranges the agenda. Kiselova should have referred it to the relevant committee, which would decide what and how“, the lawyer also shared.

„The President will now refer the matter to the Constitutional Court and if the judges are in their place, I am skeptical that these members are in their place, they should overturn this decision of Kiselova. The decision of the Constitutional Court will be interesting because the legislator did not think that someone could afford to decide alone whether a request should be considered in the National Assembly or not“, Lalov also commented.
