In just a few hours, the situation with the tariffs imposed by American President Donald Trump on a number of countries around the world changed again. At least temporarily, they will be able to remain in force - this is what the Federal Appeals Court decided. "We are pleased. We expected it. This is a big victory for the president”, Kevin Hassett, director of the American National Economic Council, commented to "Fox News”.

However, the decision of the Court of Appeals does not mean that the tariffs will remain in force permanently - this is not the final court decision. The court will review the case and rule again in June, ARD explains. White House trade representative Peter Navarro immediately stated that the Trump administration is prepared to defend its right to this tariff policy in the Supreme Court, if necessary. However, it has not yet come to that.

The decision to cancel was canceled just a few hours later

The appeals court has so far overturned the decision of the commercial arbitration court in New York, which decided hours earlier that Donald Trump had exceeded his authority by imposing the tariffs. The reason for the decision of the New York judges is that the US Constitution determines that only the US Congress can decide the country's trade policy with other countries.

The White House reacted angrily, as expected. Trump spokeswoman Caroline Levitt said that this was "yet another example of the court exceeding its authority”. Trump's deputy chief of staff, Stephen Miller, called it a "judicial coup".

What is the US president referring to?

The US government believes it has the right and therefore immediately appealed the decision of the New York court to the Court of Appeals. Levitt explained that the tariffs that Trump imposed are in response to a "serious threat to national security and the US economy", which is caused by the high US trade deficit with other countries.

It is claimed that it is precisely this alleged threat to national security that caused the appeals court to overturn the previous court decision, writes ARD. When the US president imposed the tariffs, he referred to the 1977 Emergency Act. According to it, the president receives special economic powers in the event of an emergency. No other president before Trump, however, has used the powers granted to him by this law to impose tariffs.

But the joy lasted only a few hours.

Now everything is unclear again and the question of what will happen to Trump's tariff policy remains open. It is not clear exactly when the Court of Appeals will rule. But even after this court decision, appeals may continue.
