Borislav Tsekov on Ivancheva: The Vice President's pardon does not exempt the person from criminal liability

A pardon, as an act of a president, is an act of supreme state mercy. From this point of view, seeking any legal qualification is inappropriate. It is not about pronouncing on the guilt of the person. In this particular case, Ms. Ivancheva's guilt has been confirmed by three court instances. The Vice President's pardon itself does not exempt the person from criminal liability, it only exempts him from serving the sentence. This was stated by associate professor of constitutional law Borislav Tsekov in the program “More from the Day” on BNT, quoted by novini.bg.

The president is not obliged to disclose motives, he specified and added that the power to pardon itself occurs at personal discretion.

This is only about exemption from serving a sentence, this is beyond the scope of the judiciary. This is an extraordinary power and should be exercised very rarely and only when the head of state has compelling reasons. In this case, we are talking about a corruption crime, proven in three instances, so it would be good for Ms. Yotova to disclose the motives, Tsekov also said.
