Dr. Orlin Kolev: This government remains until the appointment of an official

„Even with the resignation of the government, and a vote for such a hypothesis as we are in now, this government is preserved. That is, the resigned government will continue to function until the moment when an official one is appointed by the president, or is not regularly elected by the parliament.“

This is what constitutional law expert Dr. Orlin Kolev said in the Euronews Primetime studio.

To make it a constitutional crisis, it seems to me, is overexposed. It will not come to that, under no circumstances.

The constitutionalist explained that the president has two duties, according to the amendments to the Constitution – one is related to the formation of the caretaker government, insofar as it is given the opportunity to influence it, and the other is the scheduling of parliamentary elections within two months.

These are two parallel procedures that are not interrelated. They do not follow each other and the president should exercise them jointly, i.e. in parallel.

“In this context, two decrees are needed to fulfill these two obligations”, added the constitutionalist.

“The risk here is precisely from the formation of a caretaker government, which has a bright political color, because among the candidates who will be caretaker prime ministers are persons nominated by a certain parliamentary majority,” pointed out Dr. Kolev.
