There is a risk of a constitutional crisis, but for now the crisis remains more political. This opinion was expressed by the former acting Prime Minister and professor of Constitutional Law, Prof. Georgi Bliznashki, in the program "The Day ON AIR".
"An emergency has been created at no time, an artificial crisis. The head of state could have gone significantly more prepared for the meeting, and not been surprised by the positions of the candidate for prime minister. The behavior of Gorica Grancharova-Kozhareva surprised him. She surprised everyone, became the nation's favorite. I behave firmly and with dignity," he commented.
What do the constitutional texts say?
"It can be interpreted in different directions. A lot of colleagues took it literally. Clearly, the president has his discretion. He has the right to express an opinion, a position, but this should have been done in advance. It should not have come to this scandal", pointed out Prof. Georgi Bliznashki to Bulgaria ON AIR.
According to him, the politicization of the judiciary is the great disease that must be avoided.
"Things moved towards politicization. In France, things are holding back. In an Italy, where the ideas of a unified judicial power were the first to be launched, the Supreme Council of the Magistracy allowed politicization," the constitutionalist gave an example.
Can the Constitutional Court withstand the pressure?
"He held out and took the right position. There is reason to rethink everything. If they manage to produce a government after the elections, we can go to debate these issues. If we have a barren parliament again, it will all remain a set of good intentions. There is a practice of CS. A new ground is needed to plead unconstitutionality and it is mostly related to the mandate of the National Assembly (NA). The mandate cannot begin and end with the oath of the people's representatives. The 50th National Assembly went down in history without doing any work," Prof. Bliznashki thinks.
GERB, in the person of Boyko Borisov, made a big mistake by proposing a partisan government, he stressed.
"A frivolous approach. Borisov lived with the thought that there would be a new assembly. Deputies will have to learn what the so-called technocratic government. Radev cannot postpone the elections indefinitely. Within a week this should all be over. To understand with Glavchev, if they can. Elections cannot become a bet of political combinations and trade.
