There is a principle of continuity and since the National Assembly has not issued a new one, the current SJC has the right to elect a new chief prosecutor and carry out actions that are attributed to him by law, said Cholakov.
The second question that arises is whether it is proper for this SJC, with an expired and incomplete composition, to appoint a chief prosecutor. According to our ideas, it would rather not be right, he added.
The next question is who should choose the new Attorney General. The SJC is elected with 160 people's representatives. I don't know if it is possible for the next parliament to get that majority. If a new SJC is not elected, we will have a SJC with an empty composition, i.e. attorney general and judiciary in bulk. Replacing the entire discussion – the people must be replaced first, not the system, as they wanted in the previous parliament from the second political power, the former chairman of the legal commission pointed out.
My impression, as well as that of a former Minister of Justice, is that Mr. Sarafov behaves decently and avoids the media appearances of his predecessor.
