Politicians should make promises about the policies they will implement when are in power and the responsibility for legislative changes to be shared because changes to the judicial system were crushed by the parties represented in parliament, in one form or another. And when citizens call on ministers to present their problems to them, they should go down to them. This is what the former chairman of the Sofia District Court, Metodi Lalov, told BNR.
He commented on the opinion of the Union of Judges, with which they declare against this SJC to elect a chief prosecutor and the extra-procedural wiretapping of deputies.
"The judicial system is unfit to apply the law equally and fairly. G.G. was eavesdropped for 4 months illegally, without facts that he did anything, but sewn to other persons. Subsequently, the court condemned the prosecution for causing him property damage. "You also remember hundreds of people at the protests," recalled Adv. Lalov, who was a municipal councilor in SOS.
"Out of process information and data collection is permissible only for the purposes of the NPC. Rusi Alexiev's opinion is, excuse me, cop. Deputies can be wiretapped when the grounds of the Law on SRS and NPK are met, Metodi Lalov also said. And he stated that "we need to listen to the political candidates to improve the legislation, because when it came to MPs, they crystallized all the problems for using the SRS".
"The blame for the situation is categorically on the politicians, shared with that of the magistrates, because the magistrates in their circles do not have the resistance, at least to demand competition, to demand that the SJC be created. At some point, one has to resort to some extreme actions, including disobedience, talking to the media", believes the lawyer. Lalov.
"The position of the Union of Judges is a blow in the air because there are no legal arguments for this compromised and expired SJC not to elect a chief prosecutor. Yes, after the decision of the SC, the SJC has the right by law to make the procedure and the selection. And for the citizens to ask themselves, what is this country, what is this society, since it cannot nominate several candidates, is there really no one? Of course there is, but they know that the SJC will not accept their nominations, they will become victims and they will legitimize Sarafov in advance by creating an apparent competition", commented the former chairman of the SRS.
He did not fail to mention that Sarafov is the successor of Tsatsarov and Geshev, "he was under their wing and part of their team".
