At the moment, this composition of the SJC should not choose the new chief prosecutor, because he should be chosen in a legitimate way that inspires public confidence. This cannot be done with this composition of the SJC, which has already exceeded its mandate by two years and which has an incomplete composition. “Furthermore, with its actions so far, this composition of the SJC has given more than one reason to doubt the reasons why it makes certain decisions. These doubts in his decisions are mostly justified by a certain dependence on specific political subjects. As long as such doubts exist - not only in society, but also in the guild of magistrates, this choice cannot be made. The mandate of the SJC has expired and this council should not take any such actions that will determine our future for a very long period of time. A new composition of the SJC should be elected as soon as possible, she added.
“Let's pay attention to something else. At the moment, Borislav Sarafov has been in the function of temporary acting for a year and four months. If he is elected next January, as all the requests are, if this bench of the SJC chooses him, it will mean that he will be in office for nearly nine years. The Constitutional Court did not rule on reducing the mandate of the Prosecutor General, and he remained for 7 years, and was not reduced to 5. To have the same Prosecutor General for such a long period of time… This greatly problematizes the independence of investigations. And now we have a candidate. And when Geshev was elected, it was like that – one candidate. Geshev's election was slow, and so was his tenure. It's no accident that he became the first chief prosecutor to be deposed ahead of schedule”, lawyer Kachaunova also said.
