The Pernish court stopped the removal of the illegal buildings on the bank of the Iskar dam

The removal of illegal constructions along the banks of the Iskar dam, which the Metropolitan Municipality started, has been stopped by decision of the District Court - Pernik. This was announced by the Metropolitan Municipality. From there they explain that the Municipality will appeal the decision.

Three courts have been appealed. “Our attitude towards illegal construction is irreconcilable and we will continue to fight with all legal means,” said Sofia Mayor Vasil Terziev.

The decision of the Pernish District Court blocks the implementation of three orders of the chief architect of the Capital Municipality, which came into force and are subject to implementation after a final decision of the Supreme Administrative Court (SAC), the Municipality indicated.

The Metropolitan Municipality also reminds that for the three buildings on the bank of the Iskar dam, there is the final decision of the Court of Appeal, which confirms the orders of the chief architect of Sofia that they must be removed.

Due to the lack of voluntary performance by the owner, the Metropolitan Municipality proceeded with forced performance.

“On 11.06.2024, a notification was received in the Capital Municipality that by a ruling of the District Court – Pernik is suspending the removal of the illegal buildings due to a commercial dispute. The commercial dispute was filed by a legal entity that is different from the owner of the buildings, the subject of which is: remuneration due under a contract for the performance of construction and installation works from 03.01.2021. There are serious doubts that this is a simulative process, since the claim was filed on 07.06.2024. On the same day, a case was opened on the inventory of the District Court - Pernik. Three days later, on 10.06.2024, a request for collateral was received. With a definition of the same day, namely – On 10.06.2024, the court in Pernik admits security and issues a security order on 11.06.2024”, the Metropolitan Municipality stated in its announcement.

The forced removal of three illegal buildings on the territory of the State Hunting Farm “Iskar” started in April. Then the chief architect of the Metropolitan Municipality Zdravko Zdravkov announced that all three buildings were found to be illegal construction in 2019.
