In "Elenite" is built on a riverbed that has disappeared from the cadastre. Serious discrepancies between the cadastral maps and the real state of the riverbeds are found both in Sofia and on the Black Sea coast. In the capital, nearly half of the rivers are not reflected in the cadastre as watercourses, but as properties with different purposes - including for construction and recreational activities. Particularly indicative now is the case near the Elenite resort, where according to the cadastre, the largest hotel in the area is built on land that is legally a watercourse - a river, state public property. He announced this to Lili Marinkova in the studio of "FACT" and the show “Conversation“ Eng. Dimitar Kumanov, “Balkanka“ association.

“However, upon inspection of the properties under the hotel, it is seen that the same terrains are recorded as private properties for construction and tourist complexes. This is contrary to the law, since the riverbeds are public state property and cannot be sold, built on or changed their purpose. According to the data, the first cadastral order for this land property is from March 2005, and an amendment was made in 2011. It was then - during this period, the river “disappeared“ from the documentation - probably to open up the possibility of construction. The procedure for the change has gone through several institutions - RIEW - Burgas and the Basin Directorate, which have given positive opinions. However, by law, the Basin Directorate cannot be unaware that there is a riverbed on the site, since it appears in all hydrological maps and in the River Basin Management Plan. In order to proceed with construction on a river, someone must have given their consent – either in the environmental assessment or in the admissibility statement under the Water Act. This means that a number of officials have signed along the chain“, the guest commented.

“After the positive statements, the standard procedures under the Spatial Planning Act (SPA) began – design, issuance of a construction permit and construction of the complex. The case once again raises the issue of control over cadastral maps and their synchronization with the real hydrography of the country, as well as the responsibility of the institutions that allowed the transformation of public state property into private terrain“, says Kumanov.
