The Court of Appeal confirmed a decision of the Varna District Court, which ordered the arrest of a woman accused of possessing for the purpose of distribution 4.1 grams of marijuana and 0.29 grams of methamphetamines and that she distributed 0.07 grams of methamphetamine, reported AP-Varna, quoted by varna24.bg.

The act was committed in complicity with another accused. He is on probation for a suspended sentence for an identical crime. 26-year-old Petya St. was sanctioned for possession of drugs in another case. She appealed the first-instance ruling. Her lawyer is of the opinion that the woman has no lasting criminal habits.

She is a single mother of a one-year-old child, and this requires special care. House arrest will allow her to take them. The representative of the Appellate Prosecutor's Office did not agree with these arguments. He believes that with the previous conditional sentence, the court gave the young woman the opportunity to choose the path to continue, but she chose the wrong one.

There is no evidence that she would not break the law again by carrying out the same acts. ​The Court of Appeal accepted as convincing the data on the complicity of Petya St. They are derived from the testimony of multiple witnesses – some of them sought her out to buy drugs, others did so, and others saw her carrying out the criminal activity. A green grass table and scales were seized from the children's room and the hallway of her home. ​There is a real risk that the accused will commit a crime with a lighter measure.

This danger is derived from the intensity of the incriminated activity and the previous conviction in two criminal cases. The crime under consideration was committed during a probationary period, the court also reported.

​The child of the accused cannot be interpreted as an important social reason requiring a lighter measure of remand, since the investigated activity was carried out from the home of the accused. Some of the items were found in the children's room. The parents and close relatives of Petya St. could take care of the child, the court believes. ​

In the presence of a well-founded assumption of complicity and in the opinion that the real risk of committing a crime can only be successfully counteracted by detention, the Varna Court of Appeal confirmed the most severe remand measure against the 26-year-old woman. The determination is final.
