On May 20 of this year, two working days groups found illegal construction activities carried out during the weekends in the “Musagenitsa” quarter. The construction activities carried out are related to the laying of asphalt concrete and the removal of tree vegetation without the necessary and approved construction documents and without being coordinated with the "Student" district of the city.
„The targeted actions of self-management and malicious attitude towards the living environment in the "Student" district they will not be tolerated", said urbanist Vasilena Georgieva – head of department “Construction control and engineering infrastructure“ at CO- district “Student“ – “We are doing our best to limit their number and scope by applying the full rigor of the law, according to our powers”.
It has been established that there are no available and approved construction documents for the construction and installation works. The laid asphalt concrete is located entirely in private municipal properties 68134.1602.6103 and 68134.1602.6022. The tree vegetation available in the above-mentioned properties falls entirely within the asphalt concrete, without the construction of the necessary and required planting nests for the purpose of its storage.
An order was made: Immediately remove the asphalt concrete placed on properties 68134.1602.6103 and 68134.1602.6022. The territory affected by unregulated SMPs should be restored and improved.
Tree vegetation has been pruned within the boundaries of the specified properties. The green areas are asphalted, which tightly covers the root system of the vegetation existing in the properties without leaving any planting places in accordance with the requirements of the regulations, which prevents the development and existence of the trees. The regional administration has no data on permits issued in accordance with the requirements of the Ordinance on the construction, maintenance and protection of the green system of the Metropolitan Municipality.
It is prescribed: To remove the completed asphalting and to restore the green areas, carrying out all necessary improvement measures (supply of fertile soil – humus, fertilizing, weeding, etc.) and landscaping activities, in accordance with the district administration.
Constitutional protocol PCT24-KP71-174/20.05.2024 is issued on the basis of the powers granted under part 223, para. 2 of the Territorial Planning Act.
Constitutional protocol PCT24-KP71-175/20.05.2024 is issued in accordance with violations of Art. 35, para. 1 of NIPOZSSO. According to Art. 58, para. 1 of the same for all caused damage to the elements of the green system of the Metropolitan Municipality, the perpetrator is punished with a fine of BGN 1,000 to BGN 5,000.
