The Supreme Administrative Court upheld the decision in administrative case No. 1097 of 2024 of the Administrative Court - Blagoevgrad, related to the election of mayor of the municipality of Blagoevgrad. announced Bulgaria ON AIR.
The proceedings before the court of first instance were initiated in connection with a challenge to a decision of the Municipal Election Commission - Blagoevgrad, which announced the results of the vote for mayor of the municipality of Blagoevgrad, in the second round of the mayoral elections held on 05.11.2023 municipality of Blagoevgrad, and Metodi Baikushev from the Coalition "Continuing the change - Democratic Bulgaria" has been announced as mayor.
Regarding the complaint that persons were added to the voter lists, the court referred to the inspection carried out by DG "GRAO". She found that only four persons were improperly allowed to vote, which in no way can have an impact on the announced election result.
The cassation instance accepts that the court of first instance rightly refused to rule on the CEC's methodological instructions and on the decision of the Ministry of Electronic Government for certification of technical voting devices.
According to consistent judicial practice, incidental judicial review is inadmissible, in this case acts issued by bodies that are not a party to the proceedings are incidentally challenged, and the procedure for challenging general acts is different from the procedure for challenging individual administrative act announcing the election result.
