In June, Hunter Biden was convicted in Delaware of lying about using illegal drugs to buy a gun, and is scheduled to appear in court in September on the tax evasion case.
Biden, who has pleaded not guilty to tax evasion charges, has argued that David Weiss, the special prosecutor handling both cases, was appointed illegally.
The president's son has relied on a federal judge's decision to drop a criminal case accusing former President Donald Trump of illegally withholding classified documents after leaving office.
U.S. District Judge Eileen Cannon of Florida found that the appointment of the special prosecutor in the case, Jack Smith, violated the U.S. Constitution because Congress did not give him authority to prosecute the case.
But U.S. District Judge Mark Scarci in Los Angeles said yesterday there was no valid basis to review an earlier order denying Hunter Biden's request to dismiss the tax evasion case.
