The plenum of the SJC is meeting today to consider the issue of appointing a temporary acting chief prosecutor, BNT reported.
The meeting is at the request of the acting Minister of Justice Andrey Yankulov.
In his reasons, the Minister of Justice points out that from July 21, 2025, Borislav Sarafov is not a legitimate acting chief prosecutor, because the six-month period from the entry into force of the legal changes has expired.
In early October last year, the Supreme Court of Cassation adopted in its opinion that after this date, Sarafov no longer has the right to hold the position of chief prosecutor. Subsequently, other courts also accepted that Sarafov was no longer the chief prosecutor, and the Constitutional Court opened a case on this issue.
According to Yankulov, as interim chief prosecutor, Sarafov did not fulfill any of his own requests made to the Supreme Judicial Council after he took office in June 2023.
While the plenum of the Supreme Judicial Council is underway, a protest organized by "Justice for Everyone" is expected in front of the institution's building, NOVA reported.
They point out that Borislav Sarafov has "usurped the position and refuses to vacate it". The association supported the actions of Justice Minister Andrey Yankulov, who is demanding that Sarafov resign. "Justice for Everyone" referred to the legal changes that have come into force, which prohibit the same person from holding the position of acting prosecutor general for more than six months.
