The only real solution I see is for the Prosecutor's College to appoint a new acting prosecutor general for the next six months and that's it. This will solve the entire problem. This was stated by former Deputy Prosecutor General Boyko Naydenov in the program “Offensive with Lyubo Ognyanov“ on NOVA NEWS regarding the tension surrounding the judiciary and the actions of the Supreme Judicial Council.

According to him, the referral of the issue from the Plenum to the Prosecutor's College was completely expected. "In my opinion, there is no dispute. That is how it is written in the law and it is not that unclear", he commented.

Naydenov shared that the members of the SJC from the Prosecutor's College must take responsibility. "They have a responsibility to the entire society and should not be hostages of the past, but simply appoint another person to perform the functions for six months", he said.

According to him, the current situation creates a real problem for the work of the prosecutor's office. He added that this could lead to condemnatory decisions against Bulgaria. "Currently, there is no functioning prosecutor general who can perform his tasks, for example, to submit requests for reopening cases. A citizen seeks justice and cannot achieve it. Our country is about to be condemned repeatedly for not allowing justice to be served", said Naydenov.

Regarding the appeal of former Justice Minister Atanas Slavov against the election of the acting prosecutor general, which the Supreme Administrative Court rejected, Naydenov commented that there was "playing around" with various procedures, including referral to the Constitutional Court. "There is some playing around with individual cases", he said.

The former deputy prosecutor general said that the text of the law is clear and does not allow for expansive interpretations. "The provision is not that complicated. Six months is the right time to take up this position. That's what the legislator decided. If necessary, it can be changed. But as long as the law is like this, it must be implemented", Naydenov emphasized.

He also commented on the possibility that the prosecutor's college could use procedural mechanisms to delay and called for a quick decision. "I expect everything from the prosecutor's college, because it is currently acting with its own legal logic. The most reasonable thing is to choose a new person who will continue to work within the same framework. There is nothing for anyone to fear that there will be a change", Naydenov added.
