The current composition of The SJC can and should start a procedure for the election of a new chief prosecutor.

This was explained to NOVA NEWS by former constitutional judge Rumen Nenkov.

„A decision of the CC was adopted, which I do not support. When the National Assembly is inactive and does not elect new persons with an expired mandate, the old incumbents continue to perform their functions, he explained.

Nenkov also commented on the decision of the Constitutional Court on the changes to the Constitution.

„When everyone is unhappy with a decision, it is right. In this case, I want to defend the Constitutional Court. Both those who contested the changes to the Constitution and those who accepted them are dissatisfied with the court's decision. I think that the judges fulfilled their professional duty with dignity and are subject to baseless criticism from people who do not have a democratic mindset and do not understand the separation of powers, he explained.

When asked if he thinks that the newly elected part of the professional quota should take office and with the old ones from the political quota elect the new chief prosecutor and the new chairman of the Supreme Court, he answered as follows:

„There can be no combination between the two quotas. Any attempts to change this status quo will be cut short by the SC as there will be rulings on relevant issues. I believe that these provisions do not contradict the Constitution. A practice has been created that is harmful to the public image of the president. He selects some express people who become politicians, form parties and enter real politics".
