We are seeing a breakdown of statehood, we need political will and personal changes in the system of state organization.
This was told to the Bulgarian National Radio by Judge Atanaska Disheva, a member of the Supreme Judicial Council (SJC), and commented that the argument for this conclusion is the "Petrohan" case, as well as the cases with leaked recordings from cameras in beauty salons and a gynecological office to a pornographic sites:
"In all these cases, it is more than obvious that state bodies with specific functions have not fulfilled their obligations for control, for reaction to certain signals, for inspections. This can be overcome, but first political will must be found and then personnel changes follow, because with individuals who function and lead certain units of the state system, they cannot make changes".
In her words, it is obvious that Borislav Sarafov's holding the position of Prosecutor General at the present time is extremely convenient:
"A public fact is the continued failure to fulfill the obligation to investigate, for example. And the example of the murders in Petrokhan is just a small example of this. After months of not appearing in public, he appears and instead of giving any information about how the investigation is going, he accuses the parents of children who were at some scout camp there of sabotaging the investigation and the reason for at least 2 years of missing investigation. Then the focus is on the personality of the victims of the crime, and not a word about what the prosecution is doing. The only purpose of shifting the focus is to distract attention and to end up saying that they deserved it and this is a trend that we see in other public murders as well.
She explained that there should be an investigation and checks into what the victims of the triple murder in the "Petrohan" hut were doing, because this is one of the ways to get to the perpetrators of the crime, but in this case the focus has shifted.
In connection with the case initiated in the Constitutional Court on the "Sarafov" case, Disheva emphasized that the powers of the Constitutional Court do not allow it to say in plain text "release him from tomorrow" and does not have the right to refer to the name Borislav Sarafov, specifying that the court's decision does not have retroactive effect:
"If it decides that the text complies with the Constitution, nothing prevents him from continuing to perform his duties, because there is no retroactive effect. What in practice the members of the Prosecutorial College in the SJC said".
According to her, the members of the Prosecutorial College in the SJC should rethink their decision, because it is not based on the idea and spirit of the law.
