The government approved a request to establish the unconstitutionality of a Decision of the National Assembly.
The decision is to take action in connection with the presence of liquidity problems and the impossibility Fund "Security of the electricity system" (TFEU) to fulfill its legal obligations, adopted on 21 March 2024.
The decision was made by GERB and DPS, but it was adopted with the support of the opposition, news.bg recalls.
The decision obliges the Minister of Finance to cover the operating deficit of BGN 1 billion in the Fund by March 31, 2024. The "Security of the Electricity System" Fund is foreseen. to use the received funds to cover the expenses under Art. 366, para. 1, items 1 and 2 of the Law on Energy for the price period July 1, 2023 - June 30, 2024, according to Decision No. C-14 of June 30, 2023 of the Commission for Energy and Water Regulation.
The government considers that the decision was adopted in violation of Art. 4, para. 1, Art. 8, Art. 84, item 2, art. 87, para. 2, Art. 105, para. 1 and Art. 106 of the Constitution of the Republic of Bulgaria.
