Lawyer Silvia Petkova on the arrest of Ibryamov: At this stage, the data points to illegality - 1

Lawyer Silvia Petkova and constitutionalist Orlin Kolev with a comment in “Hello, Bulgaria” for the arrest of MP Jeyhan Ibryamov. „Fixed crime means to catch the perpetrator at the crime scene. In this case, there is information in the public space that the bribe was requested on September 25, when Mr. Ibryamov was still a person with immunity. Marking the banknotes and giving them to the potential suspect is a procedural and investigative action in the investigation against a specific person. But the limitation of parliamentary immunity prohibits taking action against the person of that person. This means that at this stage the data points to the illegality of the arrest, as it is not a crime that has been found, but a pending investigation into a crime that was known to have been committed. "The sealed crime is literally what was discovered by chance," Petkova claims.
„The strengthened legal protection that the Constitution and subsequently the Electoral Code gives to the people's representatives and to the candidates for such, excludes the hypothesis of a proven crime. The idea of immunity is, on the one hand, to protect its respective bearer, not to be unjustly accused, but he cannot hide behind it,” commented Kolev.
