Naturally, the SJC will justify the procedure it is conducting and will declare that it is legitimate, legal and in accordance with the spirit and letter of the law. And there can be no surprises in that. The question of how serious these arguments are is a separate question, said the director of the Anti-Corruption Fund Andrey Yankulov in an interview with BNR.

In the show "Above all" the former prosecutor from the SGP commented on yesterday's position, expressed by a declaration of the SJC, on the election of the chief prosecutor.

According to him, this position is not a surprise and he recalled that there were positions against the SJC also when Geshev was released.

"Then there were positions on the behavior of the SJC following the release of Ivan Geshev, and then there was also synchronicity with the parliament. I have commented on the synchronicity that occurred then and the high-speed operation of the Supreme Court, which did not see Geshev's more serious problems as chief prosecutor until then, and released him because of the expression "political garbage", recalled Yankulov.

According to him, the current situation and the dissatisfaction with the election of a chief prosecutor by the SJC with an expired mandate is the result of the inaction of the institutions.

"The inaction of the institutions is a fact and the crisis in justice, as a result, is also a fact. Indeed, it is to a large extent the fault of the National Assembly, because it does not fill its quota in the SJC, which is not a problem of the current composition. From here it would then have to be decided what to do in the least damaging way. In this situation, what the SJC should do is not to proceed with these elections", recommended the director of the anti-corruption fund.

And he added that "with benefit and harm, the SJC should still choose the lesser evil and they should be blind and deaf not to understand the total exhaustion of professional and public trust".

"It is important what the chief prosecutor would do in office, but not for the prosecutor community, but for society as a whole. "The Emancipation of Magistrates" I don't know what exactly is meant by this, but the prosecutor's office doesn't have it, how can it be, because it is a hierarchical structure", Yankulov shared.

And he pointed out that an adequate selection of the chief prosecutor goes through an adequate composition of the SJC. And the solution to the problems he sees is society maturing and demands adequate changes.

On the question of where to look for a way out - in political decisions or in the system, Andrey Yankulov commented:

"The way the processes have been going in recent years, if there were people hoping that change would come from the system, life has shown that it would be difficult because the processes going on there are negative. But the logic of parliamentary democracy is that these processes should actually be initiated from there, when our society matures and demands adequate changes in the way judicial power is exercised".
