The District Court – Ruse sentenced the Guarantee Fund to pay over 13,500 leva in compensation to a cyclist injured in a traffic accident in Slivo Pole on December 28, 2023. The decision was made after the driver of the at-fault "Great Wall" car left the scene of the accident, dunavmost.com recalls.
The court determined 13,500 leva in non-pecuniary damages for pain and suffering and 106.40 leva in pecuniary damages for medical expenses. In addition to the principal amounts, the fund will also pay legal interest, as well as 724.13 leva in legal expenses.
The incident took place at around 11:30 a.m. on December 28, 2023 in Slivo Pole, on "Khan Kubrat" Street in the direction of "Dunav" Street. The driver of a "Great Wall" car, model "Hover X6", with registration number SV 7111 MT, did not stop at a "Stop" sign in the area of the intersection with "Tsar Ivan Shishman" Street.
In this way, the driver took away the right of way from the cyclist, who was moving from left to right on "Tsar Ivan Shishman" Street. When the car entered the intersection, the cyclist changed his direction of travel to the left to avoid a collision, but nevertheless an oblique side impact occurred.
After the impact between the front tire of the bicycle and the front left fender, front bumper and roll bar of the car, the injured person fell in front of the vehicle. The driver of the "Great Wall" left the scene of the accident, which forced the injured person to seek compensation from the Guarantee Fund.
The court partially upheld the cyclist's claims. Initially, he requested 26,000 leva in non-pecuniary damages and 118.22 leva in property damages, but ultimately received significantly smaller amounts.
