Krum Zarkov: The collapse caused by one stubbornness will inevitably drag other authorities in as well - 1

"The situation is extremely clear. For the first time, we have an unprecedented refusal by the highest figure who should monitor compliance with the law - the Prosecutor General, from the implementation of the law itself. The big question is what follows from this".

This was stated to the Bulgarian National Radio by the former Secretary for Legal Affairs of the President and former Minister of Justice Krum Zarkov after the decision of the Supreme Court of Cassation for the impeachment of Prosecutor General Borislav Sarafov.

"Things seem very complicated because all those interested, mainly those who support Borislav Sarafov's position, are trying to make things complicated, but they are not. They are very simple. There is a law that says that you can be acting for 6 months. The 6 months expire and you are no longer performing them by law. And the fact that you continue to act as if you are performing them may work in front of your immediate subordinates, may work in front of your political guardians, but it cannot work in front of the court," he explained.

In an interview for the program "Nedelya 150" Zarkov also expressed his opinion on the position of the Prosecutor's Office, which, according to him, is an attack on the Supreme Court with an accusation of their independence:

"If everything was fine with Sarafov, he should be held disciplinary accountable and removed for such a position alone. This is unprecedented. The Prosecutor General and the Prosecutor's Office cannot do this".

Interpretations of the law by various institutions are not the law itself, he added. According to him, the SJC made a wrong interpretation and will be held responsible for this. "He who violates the law is held responsible", the former Minister of Justice was categorical and expressed his opinion:

"Sarafov knows very well that the interpretation of the Prosecutor's Office of the SJC on his question is absurd. If he didn't know it, the judicial office of the same body told him, which made a different interpretation. If that wasn't enough for him, the Supreme Court of Cassation told him that day too".

Krum Zarkov is adamant that the situation is extremely clear from a legal point of view. The question is what the consequences will be, he pointed out and said:

"For the system itself, they will be negative, because this is another and very heavy blow, firstly, to the authority of the prosecutor's office and secondly - to the trust in the entire judicial system. The case will probably also have political consequences, insofar as it binds the entire state authority to itself and drags it towards a crisis. The collapse, which is caused by one stubbornness, will inevitably drag the other authorities as well".

According to him, the ball is in the court of the Supreme Court's prosecutorial college, which must elect the acting chief prosecutor.

"They also showed exceptional legal cynicism and a lack of any sense of justice and refused to implement this law".

"This policy of the ostrich that hides its head in the sand is disastrous", Krum Zarkov was categorical and added:

"Some Bulgarian political figures are beginning to remind me of sloppy craftsmen who, when they see some part of a device that they don't know what it is for, shout, "Let's throw it away." This is frivolous. I didn't believe that we could reach such a situation in the political governance of the country, in which there would actually be such gross mistakes and such demonstrative violation of the law".

For him, "the brutality of the current situation is unprecedented". These are gross mistakes for which the bill will be brought to account sooner or later, he believes.

Regarding the appointment of the head of the National Security Agency and the powers of the president in this direction, Zarkov commented:

"Since there is a disagreement between the president and the prime minister, let's use the power of the majority to take away the powers of the president and solve the problem. Another gross political mistake by this majority, which is constantly shooting itself in the foot. The only thing it does is create capital in this same president to be their political alternative. These are incomprehensible moves that make me think that in this majority, the one who leads the dance will not take it far. It seems that this is Delyan Peevski".

The BSP has reached a state in which it cannot afford to go to elections, because it is afraid that it will perform even worse in them, explained the position of the leftists Krum Zarkov. According to him, the BSP needs this majority and this parliament much more than the other way around.

"I don't see in the party leadership a clear idea of what it will do when this government and majority collapse, and it will collapse sooner or later".

I do not participate in any other formations, except for the BSP, Zarkov declared.

"Right now I can't have a leading role there. But that's where my political future lies, if there is one"
