Constitutional Court initiates cases on the amendments to the SRC Act and the DAR Act  - 1

The Constitutional Court initiates constitutional case No. 16/2025 at the request of 53 members of parliament from the 51st National Assembly to establish the unconstitutionality of the amendments to Art. 19 c, items 1, 2, 3, 4, 5, 6 and 7 of the Special Intelligence Means Act, adopted by the National Assembly on October 10, 2025, re-adopted on October 30, 2025 and promulgated in issue No. 94 of November 4, 2025 in the State Gazette.

The rapporteur for the case is Judge Sasho Penov.

The Constitutional Court also initiated constitutional case No. 17/2025 at the request of 53 members of parliament from the 51st National Assembly to establish the unconstitutionality of the amendments to Art. 14, para. 1, 2 and 3, Art. 15, para. 1, Art. 16, para. 2, para. 3, para. 4 c, items 1, 2, 3, 4, 5, 6 and 7 of the Law on the State Agency "Intelligence" and Art. 7, para. 1, items 5, 6 and 7 of the Law on the Management and Functioning of the National Security Protection System, adopted by the 51st National Assembly on October 10, 2025, re-adopted on October 30, 2025 and published in issue No. 94 of November 4, 2025 of the State Gazette.

The rapporteur on the case is again Judge Sasho Penov.

We recall that with the amendments to the laws adopted by the parliament, the president was deprived of the right to appoint chairmen of DAR, DATO and DANS, as they will now be elected upon the proposal of the Council of Ministers and by a simple majority in the National Assembly. The president vetoed the amendments to the SRC Law and the DAR Law, but they were rejected by the parliament.
