The parliamentary group of the BSP-UNITED LEFT introduced the bill promised during the campaign for bankruptcy of natural persons. The petitioners emphasize that, according to a sociological study, this law is expected and approved by more than 70% of Bulgarian citizens, the coalition reports.

“The law is extremely important for people who have fallen into the called “debt slavery”, for the creditors, to whom it gives the opportunity to receive part of their claim, for the economy, because it will remove thousands of workers from the gray sector, for the social system and for the state, because it will stop the flow to “Terminal 2” ” - said the chairman of Stand Up Bulgaria and author of the bill, Maya Manolova, in her Facebook post.

We remind you that the draft law was prepared back in 2019. by the ombudsman Maya Manolova, after which it was re-introduced to the National Assembly in 2021. from the PG of “Stand up! Get out!”

According to Manolova, the bill foresees alternative procedures according to the income, property and obligations of the debtor. They are included in three groups of decisions - for declaring bankruptcy with approval of a repayment plan, for declaring the debtor bankrupt with liquidation of property and for declaring bankruptcy in the absence of income and property.

The proposal states that the debtor's declaration of bankruptcy with forgiveness of the balance of the obligations is intended to take place after a sufficiently short period of time, during which the debtor makes partial payments or his property is liquidated. For debtors who have no property and no income – the period is one year.

Remission will occur with a separate act of the court, with a check for fulfillment of the stipulated obligations. In all cases, however, the non-sequestration of the debtor's income and property is preserved, and the provided short terms and the possibility of appeal guarantee the speed and fairness of the proceedings.

“Bankruptcy proceedings should be available especially to persons who have fallen into permanent financial difficulties due to objective reasons - unemployment, health problems, loss in the family, natural disasters, etc. similar. It gives a second chance to natural persons, consumers and natural persons carrying out economic activity without being registered as traders” - Manolova was categorical.

It is based on the possibility of fair sharing of the burden of over-indebtedness between the creditors and the debtor natural person.

Although the survival of tens of thousands of Bulgarian citizens depends on the adoption of the Law on Personal Bankruptcy, 1.3 billion under the PVA, previous parliaments refused to accept it, thanks to pressure from banks, private bailiffs, debt collectors and other monopolists.

Stand Up Bulgaria made a commitment that they will insist to the coalition council of the united left PG of “BSP-UNITED LEFT” to introduce other bills prepared by them, such as a law on the ceiling of bank fees, a ceiling on the markup of basic foodstuffs, on the sealing of collection companies, as well as the texts prepared by Manolova to amend the Electoral Code - on regional census centers and active registration .
